1. Agreement and eligibility
By accessing the catalog or placing an order, you agree to these Terms and the incorporated Research Use Notice, Privacy Policy, and Shipping & Returns Policy. You must be at least 18 years old or the age of majority in your jurisdiction and have legal authority to enter into this agreement.
2. Research-use purchaser certification
Products are offered solely for lawful laboratory research. You represent and warrant that products will not be used, administered, supplied, resold, relabeled, promoted, or transferred for human or veterinary consumption, self-experimentation, diagnosis, treatment, prevention, cure, or other clinical or therapeutic use. You will not seek or rely on Qelivra for dosing, reconstitution, injection, administration, or medical or veterinary guidance.
3. Lawful purchase and compliance review
You are responsible for determining whether purchase, possession, transport, storage, handling, transfer, and use are lawful and appropriate for your circumstances. Qelivra may place an order on hold, request additional information, refuse a sale, or cancel/refund an order when it reasonably identifies compliance, fraud, safety, jurisdictional, payment, inventory, or intended-use concerns.
4. Orders, pricing, payment, and acceptance
Submitting payment does not require Qelivra to accept or fulfill an order. Orders remain subject to product availability, pricing verification, compliance review, payment confirmation, and shipping eligibility. Obvious pricing, inventory, or catalog errors may be corrected and affected orders may be cancelled and refunded. Payment card information is handled by Stripe-hosted Checkout; Qelivra does not receive full card numbers or CVC values.
5. Product information and documentation
Product descriptions, lot information, testing documents, specifications, images, and other factual statements are informational and must be supported by the corresponding verified record when presented as factual. No listing, vial image, research citation, or document should be interpreted as a representation that a product is FDA-approved, cleared, authorized, sterile, injectable, clinically appropriate, safe or effective for human or veterinary use, or fit for any unlisted purpose.
6. Prohibited conduct
- Human or veterinary use, self-experimentation, or clinical administration.
- Resale or transfer for human or veterinary use or to facilitate such use.
- Requesting dosing, reconstitution, injection, treatment, or medical/veterinary instructions from Qelivra personnel or systems.
- False identity, fraudulent payment, unlawful diversion, or attempts to bypass purchase or compliance controls.
- Misrepresenting Qelivra documents, labels, testing information, or product status.
7. Shipping, cancellation, returns, and refunds
The Shipping & Returns Policy is incorporated into these Terms. Checkout currently supports U.S. shipping addresses only. Delivery estimates are estimates, not guarantees. Cancellation may be requested before shipment but is not guaranteed until processed. Once research materials have shipped, returns are restricted because Qelivra cannot verify chain of custody, storage, or handling after dispatch, except where required by law or where Qelivra approves a remedy for an incorrect, damaged, or materially nonconforming shipment.
8. Warranty disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE, SERVICES, AND PRODUCTS ARE PROVIDED FOR THE EXPRESSLY STATED RESEARCH-USE CONTEXT AND OTHERWISE ON AN “AS IS” AND “AS AVAILABLE” BASIS. QELIVRA DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED. QELIVRA MAKES NO WARRANTY OF FITNESS FOR HUMAN OR VETERINARY USE.
9. Limitation of liability
To the maximum extent permitted by law, Qelivra and its owners, personnel, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, lost profits, lost research, or loss of data arising from the site, an order, handling, misuse, prohibited use, or third-party carrier/service-provider conduct. Any liability that cannot be excluded is limited only to the extent permitted by applicable law.
10. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold Qelivra and its owners, personnel, and contractors harmless from third-party claims, losses, liabilities, costs, and expenses arising from your unlawful, prohibited, undisclosed, or non-research use; your resale or transfer; your violation of these Terms; or your violation of another person’s rights.
11. Intellectual property
Qelivra branding, site design, original graphics, software, and original content are protected by applicable intellectual-property laws. No purchase grants rights to reproduce, relabel, impersonate, or commercially exploit Qelivra branding or documentation except as expressly authorized in writing.
12. Changes, severability, and contact
Qelivra may update these Terms prospectively. If any provision is unenforceable, the remaining provisions remain in effect to the extent permitted by law. Questions about an order or these Terms should be submitted through Qelivra Support.
